JAKARTA, Indonesia Today - The Supreme Court (MA) has on Monday (February 13) rejected a case review, a final legal attempt to get freedom, filed by Antasari Azhar, former chief of the Corruption Eradication Commission (KPK).
“(We hereby) Reject Antasari Azhar’s case review. There’s no dissenting opinion, all (of five supreme judges) have rationales,” told Suhadi, one supreme judge in a press conference this afternoon.
Suhadi, however, has yet to explain considerations of the panel of supreme judges for the ruling. The panel of supreme judges was chaired by Harifin A Tumpa, then chief justice. Four members were Djoko Sarwoko, Komariah E Saparjaya, Imron Anwari and Hatta Ali.
With the decision, Antasari will remain serving on his 18 years prison sentence. Antasari was sentenced 18 years for masterminding the murder of Nasrudin Zulkarnaen in March 2009. Nasrudin was director of PT Putra Rajawali Banjaran, a subsidiary of state-owned Rajawali Nusantara Indonesia (RNI). Both the High Court and Supreme Court rejected Antasari's appeals and affirmed the lower court verdict.
On August 9, 2011, the Judicial Commission (KY) issued a recommendation to Supreme Court regarding three judges in Antasari’s trial at the district court level. Judicial Commission declared that the judges had committed ethical violations. The Supreme Court, however, has on Monday (Feb 13) morning deleted eight points of ethics code of judges used by the Judicial Commission in assessing the judges.
Nasrudin's family members have previously expressed their hopes that Antasari will be released from prison and all charges soon. Andi Syamsudin, younger brother of Nasrudin Zulkarnaen, and his wife Dewi, were seen among visitors of the Antasari judicial review trial giving their support to Antasari. “Our wish is with this judicial review, the truth will be revealed. Our family support Antasari to be freed,” said Dewi (Sep 6, 2011).
While Jimly Asshiddiqie, former chief of the Constitutional Court (MK), stated on June 4, 2011 that he believes Antasari is a victim of misguided justice.
