Theindonesiatoday.com - PT Trisna Ocean Prime plans to file a new lawsuit against PT Prima Lestari Segarapratama to the Central JAKARTA District Court.
This is a response to earlier interlocutory decision of South Jakarta District Court which declared the court had no authority to examine and try the case. South Jakarta District Court believes the Central Jakarta District Court has the authority to try the case, Bisnis Indonesia reported.
Jefferson Dau, lawyer of PT Trisna Ocean, disappointed with the interlocutory decision, but will not appeal. "The judge has no reason in deciding the competence of the South Jakarta District Court was not authorized to examine our lawsuit. We will not appeal, but will file a new lawsuit in the Central Jakarta District Court," Jefferson said.
The lawyer said, Article 118 of HIR paragraph 4 basically states that the plaintiff, if he likes it, may file the lawsuit to the Chief of the district court that handle the location in the selected domicile. "The freedom to choose the relative competence in terms of the agreement choice of domicile, according to law, is on the plaintiff side, not defendant," Jefferson argued. (Theindonesiatoday.com)
