Prudential & IML Choose Amicable Settlement

Theindonesiatoday.com - PT Prudential Life Assurance (Prudential Indonesia) chose to come to terms with an American consulting firm, The Institute for Motivational Living Inc in relation to the disputes of copyright, which now occurs at the Central JAKARTA Commercial Court.

“At this time we agreed to have an amicable settlement and we are also formulating that amicable settlement ,” said Adolf M pangabean, the attorney of Prudential in the hearing, last week as quoted by Bisnis Indonesia.

This strengthens earlier statements from Nini Sumohandoyo, corporate marketing communication director of Prudential Indonesia, who asserted that they were working to resolve the disputes properly. Adolf pleaded to the panel of judges, chaired by Nirwana, to temporarily postpone the trial.

"In this regard we ask for the postponement of the hearing for a period of two weeks," he said.

The panel of judges finally granted approval to the request of Prudential, but on condition that if within two weeks they fail to reach an amicable agreement, the trial will be continued and Prudential have to prepare the answers on the lawsuit of The Institute. “If the amicable settlement is not achieved, then straight to the rejoinder and the plaintiff (The Institute) should prepare the evidences,” Judge Nirwana said.

In relation to this amicable settlement, Heru Muzaki as the attorney of The Institute also acknowledged. “There is an amicable settlement process and we are also still waiting for the process,” he said.

The Institute for Motivational Living Inc filed a lawsuit against PT Prudential Life Insurance for what it believes a violation of copyright committed by the insurance firm. The consulting firm basically questioned a module that has been used by Prudential entitled "Mengenai Tipe & Karakter Manusia Melalui: DISC Profile (what, why, how)". The module is considered as a substantial and unique creation of the consulting firm titled "Understanding Your Personality Style and Power Point Person to Person". (Theindonesiatoday.com)
