Theindonesiatoday.com - PT Bank OCBC NISP Tbk has filed a bankruptcy petition against a bussinessman named Liem Iwan Yuwana, who is the guarantor of the main debtor PT Metalindo Perwita, Kontan newspaper reported.

The attorney of Bank NISP, Felix Bonaparte, admitted that the bankruptcy petition was registered under the registration of No.72/PAILIT/ 2010/PN. NIAGA.JKT.PST. The petition was filed because the main debtor, PT Metalindo, has not fulfilled its obligations to the bank with the amount of Rp44,86 billion.

“The respondent [Liem Iwan Yuwana] is a guarantor of PT Metalindo who owes to the Bank NISP,” Felix said, after the hearing held in the Central JAKARTA Commercial Court, this week. Bank NISP enclosed Citibank as the other creditor of PT Metalindo.

The Central Jakarta Commercial Court held a proceedings process between those two parties with the agenda of rejoinder from the bankruptcy respondent along with written verification and any other creditors submitted by the bankruptcy applicant. The trial, led by judge Nirwana, is postponed until December 9th, 2010. 

The respondent stated that they didn’t submit evidences to the court, until the next trial held with the agenda of reading the case.

Meanwhile, the attorney of respondent, James Julianto Irawan, did not deny the existence of the debts to the Bank NISP and Citibank. The debts arose because the defendant was the personal guarantor of PT Metalindo. 

PT Metalindo itself, James said, is currently in the condition of bankrupt following the declaration of bankruptcy by Surabaya Commercial Court. While admitting the debts of PT Metalindo, he added, the respondent objected he amount of the debts claimed by the bank. (Theindonesiatoday.com)
