Toyota Sues Daya Utama on Lexus Brand Dispute

Theindonesiatoday.com- Toyota Motor Corp sues PT Lexus Daya Utama as it has registered Lexus brand at the Directorate General of Intellectual Property Rights.

In the lawsuit, Toyota said the Lexus trademark registered by the defendant has the similarities in principle to his own brand. “Registering the Lexus brand means that the defendant intends to ride the popularity of Lexus brand owned by Toyota which has nurtured many years,” said George Widjojo, on Sunday (28/11).

Toyota claims to have registered the Lexus brand on May 25th, 1992 and has been renewed on May 25th 2002. The Lexus brand was registered to protect the cars, parts, and the equipments.

However, Lexus Daya Utama denies all allegations of Toyota. Hendrawati Santoso, the attorney of Lexus Daya Utama, stated that the registration of their Lexus brand has been comply with the procedure and was not contradictive to the provisions of legislation.

She argued that there are differences in types and classes of goods. “Lexus brand owned by Lexus Daya Utama is to protect the goods categorized in class 09, while Toyota’s to protect the types of goods of class 12,” she said.

Early this year, the trademark that registered by defendant to protect all kinds of computers and its parts, accessories and its equipments, namely PC, software, computer disks, computer power supply, computer monitors, disk drive, mouse, keyboard, USB, computer memory and CD/DVDRW.

Previously, Toyota has successfully cancelled the Lexus’s brand trademarked by Budi, a food enterpreneur from Batam. The Court judged that Budi had created Lexus brand on bad faith as Lexus had been the popular brand of Toyota.

Budi registered Lexus brand to protect foods, chocolate chips, and others.
