Court Turns Down Media Group Lawsuit Against Dipo Alam

Theindonesiatoday.com - The Central JAKARTA District Court has rejected Rp1000 trillion defamation lawsuit filed by Media Group against Cabinet Secretary Dipo Alam.

Pane of the judges declared that Media Group failed to prove that Dipo’s statement had caused loss to the company, since, according to the judges, Media Group did not suffer loss in advertising revenue and readership.

However the judges, chaired by Suwidya, considered Dipo's statements, that calls for a boycott to any media (particularly Media Group) discrediting the government and prohibited government officers to appear on the Media Group talk shows, are violation of laws.

On the other hand, the judges also considered Media Group had committed violation of laws, as it mixed opinion in the news material. The judges stated that media should provide the facts instead of personal opinion.

Purwani Yanuar, lawyer of Media Group, said that the verdict is disappointing, since the judges should have been able to see potential losses if they at the same time declared that Dipo had committed violation of laws. Purwani also said that Media Group will file an appeal against the ruling.

Yosep Badoeda, Dipo Alam’s lawyer, meanwhile, said that the verdict is not profound enough. However, he satisfied that Media Group cassation was not proven.

Media Group had previously filed a lawsuit against Dipo Alam related to his statement, which called a boycott to certain media, including Media Group. Dipo allegedly issued the statement because Media Group kept publishing news deemed discrediting the government.

Media Group argues that Dipo had violated article 18 (1) of the Press Law No 40/1999. Therefore Media group filed a lawsuit demanding material compensation amounting Rp1 trillion and Rp1000 trillion immaterial compensation. (indra@theindonesiatoday.com)
