Pamapersada Nusantara

JAKARTA, Indonesia Today - The Business Competition Supervisory Commission (KPPU) declared that acquisition of PT Asmin Bara Bronang and PT Asmin Bara Jaan by PT Pamapersada, a coal mining arm of Astra’s PT United Tractors Tbk (UNTR), is not a violation of anti-monopoly law.

The KPPU legal opinion was issued after the anti monopoly agency studied the acquisition notification by PT Pamapersada and the commission's assessments to the notification.

“The acquisition contains no monopoly or unhealthy business competition practice,” said KPPU in its written statement.

KPPU also mentioned in the announcement that from document examination, the acquisition of PT Asmin Bara Bronang and PT Asmin Bara Jaan by PT Pamapersada would result in consolidated asset amounting Rp16.26 trillion.

From the assessment process, held in the period of September 12th 2011 until January 10th 2012, KPPU has examined the relevant market of the companies, market concentration and justification checklist. The commission also identified Indonesia coal market with coal stockpile analysis approach.

KPPU, from the assessment and investigation, concluded that there are no monopoly practices and unhealthy business competition in Indonesia coal market caused by the acquisition.

PT Pamapersada Nusantara has earlier finalized the 30.4% acquisition of PT Asmin Bara Baronang (ABB) and PT Asmin Bara Jaan. From the acquisition, Pama’s ownership in ABB and ABJ increased significantly from 30% to 60.4% of all shares issued. (indra@theindonesiatoday.com)
