Freeport Workers

Theindonesiatoday.com - Workers Union of PT Freeport Indonesia, a subsidiary of Freeport McMoRan (FCX), has on Thursday (Dec 1st) at the JAKARTA Industrial Relation Court stated that lawsuit filed by the company's management is premature.

According to the Gindo L Tobing, lawyer of the workers union, based on article 118 of Het Indonesische Reglement (HIR), the lawsuit should be filed in the Jayapura Industrial Relation Court instead of Jakarta Industrial Relation Court, since Freeport workers union is based in Jayapura. Therefore the defendant stated that the lawsuit is premature.

Gindo also said that the disputing parties were still in the negotiation process, therefore the company was not allowed to file any lawsuit against the workers union.

The exception will be answered by the Freeport Management on Monday (Dec 4th). The next trial was initially scheduled a week after the previous trial. The management, however, asked the court to move the trial date forward.

“We proposed the trial to be moved forward, since until now the dispute keeps the strike continues and we just entered the third month of the strike. Therefore we will file the counter-plea on Monday,” said Anthony Hilman, lawyer of Freeport Management, as quoted by Hukumonline.com. The judges granted the request.

The management of PT Freeport Indonesia has on November 2nd brought its dispute with workers union to the Industrial Relations Court. Ramdani Sirait, spokesperson of Freeport, says the management decided to take the route because of endless dispute with its workers on the salary issue. Ramdani, however, said management and workers could continue negotiations in parallel with court process.

Until November 11 the negotiation regarding collective labor agreement of PT Freeport has not met any agreement. (indra@theindonesiatoday.com)
